Terms of Service

These Terms of Service (“Terms”) govern your use of the Metropolitan Building Managers of New York member portal and the public marketing site operated by The Metropolitan Building Managers of New York, Inc. (the “Association,” founded 1944). By accessing either site or completing a membership application, you agree to these Terms.

1. Eligibility

• Individual membership is offered to working resident managers, superintendents, and approved vendors serving the New York City building-management industry.
• Memberships are individual, not organizational. One person per membership.
• Vendor memberships are subject to board approval before activation.
• The Association reserves the right to decline an application or revoke a membership for cause as determined by the board.

2. Account responsibility

• You are responsible for safeguarding your login credentials and any activity under your account.
• Notify the Association immediately if you suspect unauthorized access.
• The Association uses passwordless email-link login for some flows; you are responsible for the security of the email address tied to your account.

3. Payment terms

• Annual dues, event tickets, and other fees are processed through Square.
• Members who fail to pay dues by the renewal date may have portal access restricted to the payment page until the balance is current.
• Refund policy: refunds for event tickets are handled case-by-case by the board treasurer; contact admin@metropolitanbmny.com.

4. Vendor responsibilities

• Vendor members may not solicit non-member contacts through Association channels.
• Vendor profiles must accurately represent the services offered.
• Vendors agree to respond to inbound service requests in a timely manner.
• The Association is not party to any contract or transaction between a vendor and a member; we provide the introduction only.

5. Member directory

• The member directory is internal to the Association and not displayed publicly.
• Members may not redistribute the member directory or use it for unsolicited commercial outreach.

6. Acceptable use

You agree not to:

• Use the site to harass, defame, or harm any member, vendor, or third party.
• Attempt to access accounts or data that are not yours.
• Disrupt, probe, or attack the site or its infrastructure.
• Scrape, reproduce, or redistribute Association content without permission.

7. Insurance benefit

The life insurance benefit offered to active members is administered through a third-party carrier. Coverage is subject to the carrier's terms; the Association makes no warranty as to underwriting decisions, claim handling, or coverage amounts beyond what is published by the carrier directly.

8. Termination

• You may resign your membership at any time by emailing admin@metropolitanbmny.com.
• The Association may suspend or terminate a membership for non-payment, breach of these Terms, or as otherwise determined by the board.

9. Disclaimers and limitation of liability

The portal and marketing site are provided “as is.” The Association does not warrant uninterrupted service or freedom from errors. To the maximum extent permitted by law, the Association's liability arising out of your use of the site is limited to the amount of dues you have paid in the twelve months preceding the claim.

10. Governing law

These Terms are governed by the laws of the State of New York. Any dispute will be resolved exclusively in the state or federal courts located in New York County, New York.

11. Changes to these Terms

The Association may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the site after a revision constitutes acceptance of the updated Terms.
